After a decade of highly colorful struggle and strife (which I cover in detail in\u00a0<a href=\"https:\/\/www.amazon.com\/gp\/product\/B08HXB8GY1\" target=\"_blank\" rel=\"noopener noreferrer nofollow sponsored\" aria-label=\"my history of Tesla (Opens PDF)\">my history of Tesla<\/a>), the US is a patchwork of policies regarding Tesla\u2019s direct sales model\u2014some states allow Tesla to sell cars directly to consumers, some prohibit it, and some have reached some sort of compromise. However, while consumer advocates may wax indignant about the situation (few of us have any love for auto dealers), the ponderous political power of the dealerships will probably prevent the legacy automakers from adopting <a href=\"https:\/\/insideevs.com\/tag\/tesla-direct-sales\/\" data-inline-widget=\"internal-links\" data-type-id=\"7\" data-params=\"%7B%22tag%22%3A%22Tesla%E2%80%99s%20direct-sales%20model%22%2C%22originalTitle%22%3A%22Tesla%20direct%20sales%22%2C%22alias%22%3A%22tesla-direct-sales%22%7D\">Tesla\u2019s direct-sales model<\/a> any time soon.<\/p>\n<p>Liam Denning, writing in\u00a0<a href=\"https:\/\/www.bloomberg.com\/opinion\/articles\/2022-01-05\/car-dealership-laws-aren-t-fit-for-the-ev-age\" target=\"_blank\" rel=\"noopener noreferrer nofollow sponsored\" aria-label=\"Bloomberg (Opens PDF)\">Bloomberg<\/a>, and Robinson Meyer, writing in\u00a0<a href=\"https:\/\/www.theatlantic.com\/technology\/archive\/2022\/01\/climate-electric-vehicle-car-dealership-power\/621330\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow sponsored\" aria-label=\"The Atlantic (Opens PDF)\">The Atlantic<\/a>, argue that antiquated dealer-protection laws in the US are distorting the national auto market, and holding back the transition to EVs. They point out that overall <a href=\"https:\/\/insideevs.com\/news\/category\/sales\/\" data-inline-widget=\"internal-links\" data-type-id=\"8\" data-params=\"%7B%22section_route%22%3A%22news%22%2C%22alias%22%3A%22sales%22%7D\">EV sales<\/a> are higher in the states that don\u2019t restrict direct sales. [Mr. Meyer does not mention Mr. Denning\u2019s earlier article, but he makes precisely the same points, and cites several of the same primary sources.]<\/p>\n<p>As it stands at the moment, 17 states prohibit all automakers from selling vehicles directly to customers, while another 11 states have carved out specific exceptions for Tesla (and in some cases, other automakers that sell only EVs, which means <a href=\"https:\/\/insideevs.com\/rivian\/\" data-inline-widget=\"internal-links\" data-type-id=\"2\" data-params=\"%7B%22alias%22%3A%22rivian%22%7D\">Rivian<\/a> and <a href=\"https:\/\/insideevs.com\/lucid\/\" data-inline-widget=\"internal-links\" data-type-id=\"2\" data-params=\"%7B%22alias%22%3A%22lucid%22%7D\">Lucid<\/a>).<\/p>\n<p>Messrs. Denning and Meyer point out a number of ironic aspects of the current situation. Consider the puzzling fact that far more EVs are being sold in Florida than in New York. The two states have similar populations, but are poles apart when it comes to EV policy.<\/p>\n<p>The bright blue Empire State has implemented\u00a0<a href=\"https:\/\/chargedevs.com\/?s=new+york\" target=\"_blank\" rel=\"noopener noreferrer nofollow sponsored\" aria-label=\"a wide range of policies (Opens PDF)\">a wide range of policies<\/a>\u00a0to fight air pollution and carbon emissions, including\u00a0<a href=\"https:\/\/chargedevs.com\/newswire\/new-york-governor-hochul-signs-law-phasing-out-ice-vehicles-in-2035\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow sponsored\" aria-label=\"a plan to phase out ICE vehicles by 2035 (Opens PDF)\">a plan to phase out ICE vehicles by 2035<\/a>. New York offers incentives of up to $2,000 for EV buyers, and up to $5,000 for companies that install EV chargers. New York has adopted California\u2019s stringent emissions standards, and has directed substantial investment to public charging and electrification of public transit.<\/p>\n<p>In the Sunshine State, where all branches of state government have been in red hands for two decades, and the governor describes himself as \u201cnot a global warming person,\u201d there are no state incentives for EV buyers, and funding for high-speed highway chargers is just beginning to trickle out. (Incidentally, Florida utilities and their representatives in the state legislature are also working to kill rooftop solar in the state by implementing\u00a0<a href=\"https:\/\/www.solarunitedneighbors.org\/news\/florida-utilities-add-new-charge-to-make-solar-less-profitable\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow sponsored\" aria-label=\"a monthly minimum charge (Opens PDF)\">a monthly minimum charge<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.tampabay.com\/news\/florida-politics\/2022\/01\/11\/florida-senate-committee-advances-controversial-rooftop-solar-bill\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow sponsored\" aria-label=\"reducing net metering (Opens PDF)\">reducing net metering<\/a>.)<\/p>\n<p>So how can it be that, for the past three years, (according to research firm IHS Markit), Floridians have bought over 60 percent more EVs than New Yorkers have? Could it have something to do with the fact that Tesla, which currently sells the vast majority of EVs, has opened 17 stores and galleries in Florida, whereas in New York, it has only 5 stores, and is prohibited from opening more? (Tesla recently launched\u00a0<a href=\"https:\/\/evannex.com\/blogs\/news\/tesla-wants-to-expand-direct-sales-in-new-york-and-you-can-help\" target=\"_blank\" rel=\"noopener noreferrer nofollow sponsored\" aria-label=\"a new campaign to expand the number of permitted stores (Opens PDF)\">a new campaign to expand the number of permitted stores<\/a>.)<\/p>\n<p>\u201cIn 2020, New York\u2019s nearly 1,000 franchise dealers collectively sold less than two EVs per location,\u201d James Chen, Rivian\u2019s VP of Public Policy, told The Atlantic\u2019s Mr. Meyer. In the same year, Tesla sold nearly 1,890 vehicles at each of its New York stores.<\/p>\n<p>\u201cIf you want to see more rapid market penetration of electric vehicles, then prohibitions on direct sales are a major barrier. Whether you\u2019re free market or pro-consumer or pro-environment or pro-competition, there\u2019s something here for everyone,\u201d says Daniel Crane, a law professor at the University of Michigan, adding that in one case, both the Sierra Club and the Koch brothers signed a letter opposing a dealer-protection law.<\/p>\n<div class=\"table-wrapper\">\n<table width=\"100%\">\n<tbody>\n<tr>\n<td><img decoding=\"async\" src=\"https:\/\/cdn.shopify.com\/s\/files\/1\/0196\/5170\/files\/Tesla_1200x1200_798616d5-075e-4ec7-89ae-26daa72993f8.jpg?v=1642965690\" alt=\"\"\/><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p> <em>Above: A look at a Tesla store in Naples, Florida (Source:\u00a0<a href=\"https:\/\/www.watersideshops.com\/retailer\/tesla\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow sponsored\" aria-label=\"Waterside Shops (Opens PDF)\">Waterside Shops<\/a>)<\/em><\/div>\n<p>Dealers, of course, do not agree, and tend to depict themselves as the advocates of consumer choice. \u201cTo cater effectively to mass-market buyers\u2014of any drivetrain\u2014you need to capitalize on what has worked for mass-market buyers for generations,\u201d Jared Allen, a VP at the National Automobile Dealers Association, told The Atlantic. \u201cThe assumption that future EV buyers want the Tesla direct-sales model is just flat wrong&#8230;one of the reasons Tesla\u2019s experiment with selling direct worked was only because the company never gave their customers any other choice.\u201d<\/p>\n<p>Dealers may argue that they can provide better customer service, but that certainly hasn\u2019t been the case for EV buyers to date. EV advocates consider dealers to be\u00a0<a href=\"https:\/\/chargedevs.com\/newswire\/surprise-new-study-finds-auto-dealerships-unprepared-for-evs\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow sponsored\" aria-label=\"a major bottleneck for EV sales (Opens PDF)\">a major bottleneck for EV sales<\/a>\u2014several secret-shopper campaigns have found that most dealerships keep few or no EVs in stock, and that sales associates tend to discourage buyers from considering EVs.<\/p>\n<p>The Atlantic cites\u00a0<a href=\"https:\/\/www.sierraclub.org\/press-releases\/2021\/06\/sierra-club-releases-first-ever-nationwide-investigation-electric-vehicle\" target=\"_blank\" rel=\"noopener noreferrer nofollow sponsored\" aria-label=\"a 2019 Sierra Club study (Opens PDF)\">a 2019 Sierra Club study<\/a>, which found that legacy car dealerships were totally unprepared to sell EVs\u2014many didn\u2019t even bother to keep their demo models charged. \u201cThere were lots of untrained salespeople who couldn\u2019t answer questions about the technology,\u201d study author Hieu Le told Mr. Meyer. \u201cIn the worst case, the volunteer was urged by the salespeople to buy a gasoline vehicle.\u201d<\/p>\n<p>As long as legacy automakers were producing EVs in limited numbers (just enough to satisfy California regulators), this situation probably suited them fine. Now, however, we\u2019re cautiously optimistic that some of them (GM, Ford, VW) hope to start selling EVs in volume, and there are already signs that they\u2019re coming into conflict with their dealers. Among other issues, some dealers have been taking advantage of the ongoing supply crunch to\u00a0<a href=\"https:\/\/evannex.com\/blogs\/news\/yet-another-reason-to-like-tesla-s-direct-sales-model\" target=\"_blank\" rel=\"noopener noreferrer nofollow sponsored\" aria-label=\"slap huge markups on in-demand EV models (Opens PDF)\">slap huge markups on in-demand EV models<\/a>\u00a0such as the <a href=\"https:\/\/insideevs.com\/ford\/f-150-ev\/\" data-inline-widget=\"internal-links\" data-type-id=\"1\" data-params=\"%7B%22make_alias%22%3A%22ford%22%2C%22alias%22%3A%22f-150-ev%22%7D\">Ford F-150 Lightning<\/a>. The automaker plans to make Cadillac an electric-only brand, and rather than force its dealers to make substantial investments in chargers and other required equipment and training, GM gave them the option to drop the Cadillac brand and accept a cash buyout. According to the\u00a0<a href=\"https:\/\/www.freep.com\/story\/money\/cars\/general-motors\/2020\/12\/12\/gm-michigan-cadillac-dealers-electric-vehicles\/6497967002\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow sponsored\" aria-label=\"Detroit Free Press (Opens PDF)\">Detroit Free Press<\/a>, about 20% of Cadillac\u2019s national dealer network took the buyouts.<\/p>\n<p>Savvy dealers realize that fighting electrification is a losing battle, and some are taking steps to make sure they\u2019re still adding value under the new order. Last November, John Voelcker reported in\u00a0<a href=\"https:\/\/www.caranddriver.com\/news\/a37954876\/nada-car-dealers-help-shoppers-buy-electric-vehicles\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow sponsored\" aria-label=\"Car and Driver (Opens PDF)\">Car and Driver<\/a>\u00a0that the National Auto Dealers Association (NADA) will work with startup\u00a0<a href=\"https:\/\/www.chargeway.net\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow sponsored\" aria-label=\"Chargeway (Opens PDF)\">Chargeway<\/a>\u00a0to teach EV sales techniques to its member dealers, and to help them get up to speed on charging, available incentives for EV purchases, and other important topics.<\/p>\n<p>No legacy automaker would ever publicly admit to any dissatisfaction with the current dealership system, but it certainly appears that they (and some of the dealerships themselves) look at Tesla\u2019s direct sales model with more than a touch of envy. During the pandemic-induced lockdowns, many auto dealers\u00a0<a href=\"https:\/\/evannex.com\/blogs\/news\/tesla-s-online-sales-model-may-soon-become-the-norm\" target=\"_blank\" rel=\"noopener noreferrer nofollow sponsored\" aria-label=\"started exploring things (Opens PDF)\">started exploring things<\/a>\u00a0like online sales and valet-style pickup and delivery services. In Europe, where the dealership model is less rigid, automakers have been\u00a0<a href=\"https:\/\/evannex.com\/blogs\/news\/european-automakers-flirt-with-tesla-style-direct-sales\" target=\"_blank\" rel=\"noopener noreferrer nofollow sponsored\" aria-label=\"flirting with the brave new world of direct sales (Opens PDF)\">flirting with the brave new world of direct sales<\/a>.<\/p>\n<p>However, even if Big Auto wanted to break it off with Big Auto Dealership, it isn\u2019t going to happen in the US, where auto dealers and their trade associations wield a lot of political power. The top dealership groups in America have collective annual revenue of $10 billion, and they command more market share than any automaker. \u201cThese are huge multistate businesses. Lots of them are publicly traded, and they\u2019re politically extremely powerful,\u201d says Professor Crane. Dealers are major donors to local and state campaigns, and more than a few state and federal legislators own auto dealerships themselves.<\/p>\n<p>This local concentration of political power has created another strange situation: state dealership laws don\u2019t correspond to political divisions. \u201cDeep-red Utah allows direct sales, but blue-blooded Connecticut does not,\u201d Mr. Meyer writes. \u201cTax-and-spend California permits direct sales, but free-market-loving Texas doesn\u2019t.\u201d<\/p>\n<p>Supposedly freedom-loving Texas has been one of the major fronts in the Tesla-vs-dealers conflict (as recounted in\u00a0<a href=\"https:\/\/www.amazon.com\/gp\/product\/B08HXB8GY1\" target=\"_blank\" rel=\"noopener noreferrer nofollow sponsored\" aria-label=\"a certain book (Opens PDF)\">a certain book<\/a>). In 2013, <a href=\"https:\/\/insideevs.com\/news\/category\/elon-musk\/\" data-inline-widget=\"internal-links\" data-type-id=\"8\" data-params=\"%7B%22section_route%22%3A%22news%22%2C%22alias%22%3A%22elon-musk%22%7D\">Elon Musk<\/a> personally testified in favor of a bill that would have carved out an exception to the state\u2019s ban on direct sales. \u201cIt is crazy that Texas, which prides itself on individual freedom, has the most restrictive laws in the country protecting the big auto dealer groups from competition,\u201d said he. The pro-Tesla bill failed to move forward in the legislative session. When the Austin Gigafactory starts producing cars, they will apparently have to be\u00a0<a href=\"https:\/\/evannex.com\/blogs\/news\/will-tesla-really-have-to-ship-vehicles-out-of-texas-and-back-again-to-sell-to-state-residents\" target=\"_blank\" rel=\"noopener noreferrer nofollow sponsored\" aria-label=\"shipped across the state line, then back again (Opens PDF)\">shipped across the state line, then back again<\/a>, before they can be sold to Texas buyers. It\u2019s a puzzling policy for a state that prides itself on its laissez-faire, pro-business atmosphere.
