But the approach will make it difficult for the plaintiffs. <\/p>\n<p>They need to prove that Tesla intentionally misled customers into thinking they were buying vehicles that would become self-driving. They would need to prove that Tesla knew it couldn\u2019t deliver on the promise, which could be difficult to do.<\/p>\n<p>Tesla never promised a specific timeline for delivering on the goal, but CEO Elon Musk previously said that Tesla would achieve self-driving in 2020. The goal has been delayed several times.<\/p>\n<p>In the motion to dismiss, Tesla argues that the complaint actually shows that Tesla has been working toward the goal of self-driving:<\/p>\n<blockquote class=\"wp-block-quote\" readability=\"9\">\n<p>To the contrary, allegations in the Complaint demonstrate that Tesla has been constantly improving its ADAS technology by releasing software updates, with a goal of achieving more and better autonomy capabilities in the future.<\/p>\n<\/blockquote>\n<p>Tesla also references several comments made by the company and CEO Elon Musk that constituted warnings that there will be issues bringing self-driving to market. <\/p>\n<blockquote class=\"wp-block-quote\" readability=\"10\">\n<p>In addition, from early on, Tesla made clear that \u201cthere will still be a significant time gap, varying widely by jurisdiction, before true self-driving is approved by regulators.\u201d<\/p>\n<\/blockquote>\n<p>The company ends its argument by saying that \u201cthe Complaint identifies no specific timeline promised by Tesla to release fully autonomous capabilities to the general public.\u201d<\/p>\n<figure class=\"wp-block-embed alignwide is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\">\n<p>\n<iframe id=\"post-youtube-video-1\" title=\"Elon Musk Promising FSD for 3 Minutes Straight at Autonomy Day 2019\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/5cFTlx68itk?feature=oembed&amp;rel=0&amp;enablejsapi=1\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen=\"\">[embedded content]<\/iframe>\n<\/p>\n<\/figure>\n<h2 id=\"h-electrek-s-take\">Electrek\u2019s Take<\/h2>\n<p>It\u2019s interesting that at least Tesla admits failure to achieve the goal because I\u2019ve seen them moving the goalposts as of late.<\/p>\n<p>Musk went from mentioning \u201c1 million robotaxi on the road by the end of the year\u201d to \u201c1 million people with FSD Beta by the end of the year\u201d to \u201canyone who bought FSD will get access to the Beta in North America by the end of the year.\u201d<\/p>\n<p>Tesla has now achieved that last version of the goal, but that\u2019s so far from the original goal that it\u2019s not in the same league.<\/p>\n<p>On top of what we hear about <a href=\"https:\/\/electrek.co\/2022\/12\/06\/tesla-radar-car-next-month-self-driving-suite-concerns\/\" target=\"_blank\" rel=\"noreferrer noopener\">a new sensor suite potentially coming<\/a>, things are not looking great on the FSD front. As I have said for a long time, Tesla should at least offer refunds to those who bought the FSD package.<\/p>\n<div class=\"ad-disclaimer-container\" readability=\"6.3518518518519\">\n<p
