{"id":38693,"date":"2022-12-21T00:04:25","date_gmt":"2022-12-21T05:04:25","guid":{"rendered":"https:\/\/autosector.com\/?p=38693"},"modified":"2022-12-21T00:04:25","modified_gmt":"2022-12-21T05:04:25","slug":"ev-tax-credit-battery-rule-delay","status":"publish","type":"post","link":"http:\/\/autosector.com\/?p=38693","title":{"rendered":"Tesla, GM \u2014 and their buyers \u2014 stand to benefit from EV tax credit rule delay &#8211; Autoblog"},"content":{"rendered":"<p>Big news out of the federal government could be a big boon for certain automakers.<\/p>\n<p>The\u00a0<a class=\"link \" href=\"https:\/\/home.treasury.gov\/news\/press-releases\/jy1173\" target=\"_blank\" rel=\"noopener sponsored noreferrer\" data-ylk=\"elm:context_link;itc:0;pos:1;sec:donut-hole;cpos:0;\" data-rapid_p=\"66\" data-v9y=\"1\">Treasury Department said yesterday<\/a>\u00a0it would delay releasing proposed guidance regarding the sourcing of EV batteries that are part of the Inflation Reduction Act\u2019s (IRA) new $7,500 EV tax credit.<\/p>\n<p>The IRA\u2019s rules regarding the EV tax credit require that $3,750 of the credit is only eligible if 40% of the value of the critical minerals in the battery have been\u00a0<a class=\"link \" href=\"https:\/\/www.congress.gov\/117\/plaws\/publ169\/PLAW-117publ169.pdf\" target=\"_blank\" rel=\"noopener sponsored noreferrer\" data-ylk=\"elm:context_link;itc:0;pos:1;sec:donut-hole;cpos:1;\" data-rapid_p=\"67\" data-v9y=\"1\">\u201cextracted or processed\u201d<\/a>\u00a0in the U.S., or a country with a U.S. free-trade agreement. The Treasury has delayed guidance for this requirement until March, instead of January 1, 2023.<\/p>\n<p>The other $3,750 portion of the credit is contingent on having 50% of the battery components built in North America. The IRA EV tax credit also requires that EVs are assembled in North America, along with pricing ($55,000 for cars and $80,000 for <a class=\"injectedLinkmain\" href=\"https:\/\/www.autoblog.com\/truck\/\" data-ylk=\"elm:context_link;itc:0;pos:1;sec:donut-hole;cpos:2;\">trucks<\/a>, SUVs) and income requirements to meet in order to receive the credits.<\/p>\n<p>The delay in the critical minerals guidance is a big deal for manufacturers like <a class=\"injectedLinkmain\" href=\"https:\/\/www.autoblog.com\/category\/gm\/\" data-ylk=\"elm:context_link;itc:0;pos:1;sec:donut-hole;cpos:3;\">GM<\/a> (<a class=\"link \" href=\"https:\/\/finance.yahoo.com\/quote\/GM?p=GM&amp;.tsrc=fin-srch\" target=\"_blank\" rel=\"noopener noreferrer\" data-ylk=\"elm:context_link;itc:0;pos:1;sec:donut-hole;cpos:4;\" data-rapid_p=\"68\" data-v9y=\"1\">GM<\/a>) and Tesla (<a class=\"link \" href=\"https:\/\/finance.yahoo.com\/quote\/TSLA?p=TSLA&amp;.tsrc=fin-srch\" target=\"_blank\" rel=\"noopener noreferrer\" data-ylk=\"elm:context_link;itc:0;pos:1;sec:donut-hole;cpos:5;\" data-rapid_p=\"69\" data-v9y=\"1\">TSLA<\/a>), because they are going to be reinstated into the EV tax credit regime on January 1st. Under the prior rules of the EV tax credit, GM and Tesla were phased out of any credits because they had reached the overall sales threshold of 200,000 EVs sold for those credits.<\/p>\n<p>In addition, GM and Tesla were likely only going to receive half the tax credit due to the battery critical minerals requirement. The delay until at least March means for most of Q1 and possibly beyond, some of their EV offerings will be eligible for the full EV tax credit of $7,500, assuming the buyer has met the income requirements.<\/p>\n<p>GM and Tesla Vehicles that are eligible for the full tax credit include:<\/p>\n<ul class=\"caas-list caas-list-bullet\">\n<li>\n<p><a class=\"injectedLinkmain\" href=\"https:\/\/www.autoblog.com\/chevrolet\/bolt+ev\/\" data-ylk=\"elm:context_link;itc:0;pos:1;sec:donut-hole;cpos:6;\">Chevrolet Bolt EV<\/a> and EUV<\/p>\n<\/li>\n<li>\n<p><a class=\"injectedLinkmain\" href=\"https:\/\/www.autoblog.com\/cadillac\/lyriq\/\" data-ylk=\"elm:context_link;itc:0;pos:1;sec:donut-hole;cpos:7;\">Cadillac LYRIQ<\/a><\/p>\n<\/li>\n<li>\n<p><a class=\"injectedLinkmain\" href=\"https:\/\/www.autoblog.com\/tesla\/model+3\/\" data-ylk=\"elm:context_link;itc:0;pos:1;sec:donut-hole;cpos:8;\">Tesla Model 3<\/a> (rear wheel drive)<\/p>\n<\/li>\n<li>\n<p><a class=\"injectedLinkmain\" href=\"https:\/\/www.autoblog.com\/tesla\/model+y\/\" data-ylk=\"elm:context_link;itc:0;pos:1;sec:donut-hole;cpos:9;\">Tesla Model Y<\/a> (long range &amp; performance trims)<\/p>\n<\/li>\n<\/ul>\n<p>Note that Ford, which is also eligible for the tax credit but was never phased out, is also eligible for the full tax credit too for certain vehicles. Sen. Joe Manchin (D-WV), who was instrumental in creating the IRA\u2019s tax credit incentives, <a class=\"link \" href=\"https:\/\/www.reuters.com\/world\/us\/us-senator-manchin-says-treasury-should-limit-commercial-ev-tax-credit-use-2022-12-13\/\" target=\"_blank\" rel=\"noopener sponsored noreferrer\" data-ylk=\"elm:context_link;itc:0;pos:1;sec:donut-hole;cpos:18;\" data-rapid_p=\"70\" data-v9y=\"1\">says Treasury should limit<\/a>\u00a0the use of the commercial EV tax credit for leasing.<\/p>\n<p>&#8220;Some automakers and foreign governments are asking your agency for a broad interpretation of 45W that would allow <a class=\"injectedLinkmain\" href=\"https:\/\/www.autoblog.com\/tag\/rental+car\/\" data-ylk=\"elm:context_link;itc:0;pos:1;sec:donut-hole;cpos:19;\">rental cars<\/a>, leased vehicles, and rideshare vehicles (such as those used for <a class=\"injectedLinkmain\" href=\"https:\/\/www.autoblog.com\/tag\/uber\/\" data-ylk=\"elm:context_link;itc:0;pos:1;sec:donut-hole;cpos:20;\">Uber<\/a> and <a class=\"injectedLinkmain\" href=\"https:\/\/www.autoblog.com\/tag\/lyft\/\" data-ylk=\"elm:context_link;itc:0;pos:1;sec:donut-hole;cpos:21;\">Lyft<\/a>), a huge piece of the U.S. vehicle market, to be eligible for the full $7,500 <a class=\"injectedLinkmain\" href=\"https:\/\/www.autoblog.com\/category\/commercial-trucks\/\" data-ylk=\"elm:context_link;itc:0;pos:1;sec:donut-hole;cpos:22;\">commercial vehicle<\/a> credit as a way to bypass the strict sourcing requirements,&#8221; Manchin wrote in a letter to Treasury, noting his concerns.<\/p>\n<p><strong>Pras Subramanian is a reporter for Yahoo Finance.
