The Munich Regional Court ruled that the name of NIO\u2019s EV models were too similar and could be confused with an electric <a href=\"https:\/\/electrek.co\/guides\/audi\/\" target=\"_blank\" rel=\"noreferrer noopener\">Audi<\/a>.<\/p>\n<p><span id=\"more-277853\"\/><ins class=\"adsbygoogle author_ad ad-container adsbygoogle author_ad hide-lg author-in-content\" data-ad-host=\"ca-host-pub-5506057612223327\" data-ad-client=\"ca-pub-9669137141129422\" data-ad-format=\"auto\"\/><\/p>\n<h2 id=\"h-audi-wins-in-court-over-nio-ev-model-names\">Audi wins in court over NIO EV model names<\/h2>\n<p>Audi initially sued NIO in 2021 over the protection of its S6 and S8 model names at the European Patent Office, citing the newcomer\u2019s names sound too much like its own. According to German newspaper <em><a href=\"https:\/\/www.automobilwoche.de\/bc-online\/audi-sieg-im-markenstreit-vor-gericht-gegen-nio\" target=\"_blank\" rel=\"noreferrer noopener\">Automobilwoche<\/a><\/em>, the court agreed with Audi on Thursday after over a 15-month-long battle.<\/p>\n<p>The German court has ruled that two electric NIO SUVs, the <a href=\"https:\/\/electrek.co\/guides\/nio-es6\/\" target=\"_blank\" rel=\"noreferrer noopener\">ES6<\/a> and <a href=\"https:\/\/electrek.co\/guides\/nio-es8\/\" target=\"_blank\" rel=\"noreferrer noopener\">ES8<\/a>, sound too similar to the German automaker\u2019s existing S6 and S8 models. <\/p>\n<p>Although the judge did note that NIO\u2019s names were, in fact, different than Audi\u2019s, the letter \u201cE\u201d was not enough to distinguish a difference because it can be confused with an \u201celectric\u201d Audi model.<\/p>\n<p>Consumers may see this as simply a change from a gas-powered Audi to an electric one, agreeing with the premium automaker. The judge said:<\/p>\n<blockquote class=\"wp-block-quote\" readability=\"8\">\n<p>There is a risk that consumers will assume that the \u2018ES 6\u2019 is the \u2018S 6\u2019 in the electric version, that the two vehicles are from the same manufacturer. There is therefore a transfer danger of confusion through association that goes beyond pure association.<\/p>\n<\/blockquote>\n<p>The judgment is not final, and it\u2019s expected NIO will appeal the decision. As of right now, NIO is prohibited from advertising the ES6 and ES8 in Germany and faces a fine of 250,000 euros (roughly $270,000) or up to six months in prison for the managing director of NIO Germany.<\/p>\n<p>The NIO models are yet to be available in Germany. NIO did launch its first EV, the \u201c<a href=\"https:\/\/electrek.co\/guides\/nio-es7\/\" target=\"_blank\" rel=\"noreferrer noopener\">ES7<\/a>\u201d model, in the region, renaming it to EL7 in October.<\/p>\n<p>As you could presume, Audi welcomed the decision, saying its brands are \u201cof central importance\u201d and \u201cwe must protect them comprehensively.\u201d Meanwhile, NIO is examining its next steps, including a likely appeal.<\/p>\n<h2>Electrek\u2019s Take<\/h2>\n<p>On the one hand, it looks like a classic case of an established brand (Audi) picking on the new guy (NIO) in its home court. However, the names are nearly identical, and the judge makes a good point that consumers will likely get confused as Audi transitions to an all-electric lineup.<\/p>\n<p>NIO has been expanding rapidly, delivering 122,486 EVs in 2022, primarily in its home market of China.
