She\u2019s now succeeded in throwing out Tesla\u2019s arbitration case against her, and hopes to meet Tesla directly in open court in a case that could influence corporate policy nationwide.<\/p>\n<p><span id=\"more-412025\"\/><\/p>\n<p>Christina Balan is a Romanian-born engineer who formerly worked for Tesla on the Model S. Her contributions were significant enough that her initials appeared on the Model S\u2019 battery pack.<\/p>\n<p>But in 2014, she brought up what she considered a safety issue directly with Elon Musk. She thought that the Model S\u2019 floor mats could cause a brake safety issue, similar to a situation that <a href=\"https:\/\/en.wikipedia.org\/wiki\/2009%E2%80%932011_Toyota_vehicle_recalls\">Toyota had recently gone through<\/a> (though that also led to a media firestorm that <a href=\"https:\/\/hbr.org\/2011\/02\/toyotas-recall-crisis-full-of\">blew the issue out of proportion<\/a>). She said that Tesla had chosen suppliers based on friendships, not quality.<\/p>\n<p>And she brought it up directly to Musk because\u2026 he told her to. Famously, in 2013, Musk sent out an email to the entire company stating:<\/p>\n<p>\t<span class=\"outbrain-ad-label\">Advertisement &#8211; scroll for more content<\/span><\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\" readability=\"17\">\n<p>Anyone at Tesla can and should email\/talk to anyone else according to what they think is the fastest way to solve a problem for the benefit of the whole company.\u00a0 You can talk to your manager\u2019s manager without his permission, you can talk directly to a VP in another dept, you can talk to me, you can talk to anyone without anyone else\u2019s permission. Moreover, you should consider yourself obligated to do so until the right thing happens.<\/p>\n<p>-Elon Musk, email to all Tesla employees, March 21, 2013<\/p>\n<\/blockquote>\n<p>A few days after sending that email, Balan said she was offered a meeting with Musk, but that when she showed up to the meeting, it was instead attended by a lawyer and some large men in uniforms, and with Tesla forcing her to resign her position.<\/p>\n<p>During that meeting, Balan says that Tesla\u2019s lawyer threatened to deport many members of her team, who were currently waiting on green card applications, if she didn\u2019t sign the resignation, seemingly in response to her team backing her up in raising these concerns. After this, Balan says she faced difficulty in finding work as companies feared ending up on Musk\u2019s blacklist.<\/p>\n<p>Balan filed a defamation suit over the press statement, but Tesla forced her case into arbitration and got the defamation suit thrown out. Forced arbitration is widely used by companies in America to find faster and more corporate-friendly rulings, an approach that has only become more common after <a href=\"https:\/\/www.aclu.org\/news\/womens-rights\/supreme-court-favors-forced-arbitration-expense-workers\">endorsement<\/a> by the \u201c<a href=\"https:\/\/electrek.co\/2024\/06\/28\/among-incredibly-stupid-court-opinions-overturning-chevron-takes-the-cake\/\">Supreme<\/a>\u201d Court.<\/p>\n<p>Balan then appealed that decision, and after many delays (some related to her fight against breast cancer, which is now in remission), she finally <a href=\"https:\/\/law.justia.com\/cases\/federal\/appellate-courts\/ca9\/22-16623\/22-16623-2025-04-14.html\">succeeded<\/a> in <a href=\"https:\/\/www.courthousenews.com\/ninth-circuit-hands-win-to-ex-tesla-engineer-in-fight-over-arbitration-award\/\">getting the arbitration thrown out on Monday<\/a> \u2013 even though she represented herself, <em>pro se<\/em>, for most of the proceedings.<\/p>\n<p>Her win could be significant for corporate policy nationwide, as it could serve to chill the overuse of arbitration which is seen by most observers as giving disproportionate power to companies in labor disputes. However, given the nature of the court\u2019s recent finding, which was found to be a jurisdictional issue, this decision may not be directly applicable to many other arbitration cases.<\/p>\n<p>Now, Balan wants to face Tesla in open court with her case, and hopes to bring more of her story to the public \u2013 which she says Musk has tried to stop her from doing, despite his claims of being a \u201cfree speech absolutist.\u201d<\/p>\n<p>She said so in an interview this weekend with The Times UK, a media organization owned by climate denier Rupert Murdoch, who is also the father of James Murdoch, a Tesla boardmember.<\/p>\n<p>In the interview, Balan describes working conditions under Musk, and that he was a mostly-absent CEO who only showed up to the office twice a month, would threaten or retaliate against those who tried to fix problems. She says that she wants to take her case to open court \u201cto prove how vindictive this monster is. There will likely be more steps to come, many of which are boring legal maneuvers, but perhaps this case will now have a chance to go more public now that the arbitration decision has been thrown out.<\/p>\n<p>And, frankly, I think the initial complaint over floor mats was probably not all that significant of a blockbuster. At the time, floor mats were getting a lot of focus due to the high-profile nature of the Toyota case (which was <a href=\"https:\/\/hbr.org\/2011\/02\/toyotas-recall-crisis-full-of\">also overstated)<\/a>, so I think Balan\u2019s team was probably more wary than usual. And we didn\u2019t go on to see a slate of floor mat problems with the Model S in the time since.<\/p>\n<p>However, Tesla\u2019s response to bringing up the safety issue is still unacceptable (to say the least). Not only were all employees told to take steps like this to get problems solved by the CEO himself, but the strong-arm nature of a quick firing in response, and then threatening her team with deportation is beyond the pale.<\/p>\n<p>While we only have Balan\u2019s words as evidence for the deportation threat, we have since seen Musk take vindictive actions against entire teams, and seen his anti-immigrant attitudes including the desire to deport people illegally.<\/p>\n<p>Recently Musk<a href=\"https:\/\/electrek.co\/2024\/04\/29\/tesla-conducting-more-layoffs-including-entire-supercharger-team\/\"> fired the entire supercharger team<\/a>, in what was probably the <a href=\"https:\/\/electrek.co\/2024\/05\/03\/read-the-wild-email-tesla-is-sending-to-suppliers-amid-supercharger-chaos\/\">dumbest business decision Tesla has ever made<\/a>, reportedly because Rebecca Tinucci, a star of the auto industry and the head of the most successful team in Tesla, refused to fire more people.<\/p>\n<p>(Incidentally, another longtime Tesla exec who was fired at the same time as the whole Supercharger team, Daniel Ho, had previously praised Balan, saying \u201cwithout creative engineers like you, this place would be just another car company\u201d)<\/p>\n<p>And Musk is also the <a href=\"https:\/\/electrek.co\/2024\/07\/15\/just-after-his-huge-stock-grant-elon-musk-commits-45mil-mo-to-harm-evs\/\">largest financial backer<\/a> of an administration that is currently<a href=\"https:\/\/apnews.com\/live\/donald-trump-news-updates-4-14-2025\"> illegally deporting US citizens<\/a> to a prison famous for <a href=\"https:\/\/www.counterpunch.org\/2025\/03\/21\/beatings-overcrowding-and-food-deprivation-us-deportees-face-distressing-human-rights-conditions-in-el-salvadors-mega-prison\/\">beatings, overcrowding and food deprivation<\/a> that some have called a place to \u201c<a href=\"https:\/\/www.bbc.com\/news\/world-latin-america-68244963\">dispose of people without formally applying the death penalty<\/a>.\u201d<\/p>\n<p>He has spent much of his public advocacy in recent years showing racist and anti-immigrant attitudes, including <a href=\"https:\/\/www.dw.com\/en\/german-election-why-elon-musk-is-promoting-the-far-right-afd\/a-71186763\">support<\/a>\u00a0for\u00a0<a href=\"https:\/\/www.tpr.org\/podcast\/the-source\/2024-07-31\/frontline-investigates-the-rise-of-the-neo-nazi-afd-party-in-germany\">German neo-Nazis<\/a> and <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/03\/14\/elon-musk-hitler-federal-workers\/82402023007\/\">agreeing with a defense of Hitler\u2019s actions in the Holocaust<\/a>. He\u2019s focused more on pushing his<a href=\"https:\/\/www.cnn.com\/2023\/11\/17\/business\/elon-musk-reveals-his-actual-truth\/index.html\"> white supremacist views<\/a> than on anything to do with <a href=\"https:\/\/electrek.co\/2025\/01\/22\/elon-musk-is-not-good-for-america-or-the-world-according-to-himself\/\">EVs and climate change<\/a> (which <a href=\"https:\/\/electrek.co\/2024\/08\/13\/elon-musk-is-wrong-about-climate-change\/\">he\u2019s now pushing denial of<\/a>), thus <a href=\"https:\/\/electrek.co\/2024\/08\/06\/tesla-loses-corporate-sales-over-elon-musk-tesla-mission\/\">working against Tesla\u2019s mission<\/a>.<\/p>\n<p>So, making deportation threats against immigrants does not seem out of character, despite Musk being <a href=\"https:\/\/www.cnn.com\/2024\/09\/29\/us\/elon-musk-immigration-gray-area-cec\/index.html\">a formerly \u201cillegal\u201d immigrant<\/a> himself.<\/p>\n<p>Either way, we look forward to hearing more about this case as it goes on, in the hopes that it can both elucidate more for the public what the real Elon Musk is like, and possibly do something to reduce, ever so slightly, the abuse of the arbitration system by companies.<\/p>\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n<p><em>Charge your electric vehicle at home using rooftop solar panels.
