Photo: <a href=\"https:\/\/www.flickr.com\/photos\/steven-buss\/349912280\">Steven Buss on Flickr<\/a>\t\t\t<\/figcaption><\/figure>\n<p>Republicans in Congress have voted to use the Congressional Review Act to roll back California\u2019s states\u2019 right to protect its own residents\u2019 lungs and pocketbooks with better pollution rules.<\/p>\n<p>But here\u2019s the thing: Congress doesn\u2019t <em>have<\/em> that authority because that\u2019s not how the Congressional Review Act works, so the republican party is once again just letting everyone know that it wants to poison Americans and raise their fuel costs, no matter the legality of doing so.<\/p>\n<p><span id=\"more-417213\"\/><\/p>\n<p>We\u2019ve heard plenty of stories recently about how the senile felon squatting in the White House <a href=\"https:\/\/electrek.co\/2025\/04\/03\/americans-already-losing-jobs-to-tariffs-900-laid-off-as-stellantis-idles-plants\/\">wants<\/a> to <a href=\"https:\/\/electrek.co\/2025\/04\/02\/trump-announces-sweeping-tariffs-ranging-from-10-to-46-will-increase-cost-of-everything\/\">harm<\/a> <a href=\"https:\/\/electrek.co\/2025\/04\/10\/china-just-won-the-ev-race-due-to-trump-its-now-negotiating-closer-trade-with-eu\/\">Americans<\/a>. But in the last 100 days of the exact kind of incompetent flailing that anyone with half a brain expected out of him, relatively <em>less<\/em> attention has been paid to the attempts of republicans in Congress to poison Americans.<\/p>\n<p>Well, they\u2019ve decided to jump into the spotlight and remind everyone just how bad the entire party is, as republicans in Congress have voted to increase pollution and fuel costs for California and 11 other states.<\/p>\n<p>\t<span class=\"outbrain-ad-label\">Advertisement &#8211; scroll for more content<\/span><\/p>\n<p>The vote comes in the form of a Congressional Review Act (CRA) action withdrawing California\u2019s \u201cwaiver\u201d from the EPA, even though the CRA does not apply to the waiver. The <a href=\"https:\/\/electrek.co\/2025\/05\/01\/congress-impotently-declares-end-to-ca-ev-rule-it-cant-actually-end\/\">House voted on the same resolution a few weeks ago<\/a>, and the Senate has passed its resolution today.<\/p>\n<p>For more than half a century, California has asked for and been granted this waiver that allows it to set its own emissions rules. Other states can follow California\u2019s rules (and around 11 states do so, though that amount differs for each rule), as long as they do so exactly, and as long as those rules are stronger than the national ones.<\/p>\n<p>It has this unique authority because California had its own Clean Air Act before the federal Clean Air Act was passed, and because the state had a unique problem with smog at the time and needed stricter rules than the rest of the country. So a carveout was made in the federal law in recognition of this.<\/p>\n<p>California\u2019s clean air laws have been effective in reducing pollution, with vehicle-based pollutants <a href=\"https:\/\/csl.noaa.gov\/news\/2012\/119_0809.html\">dropping by 98%<\/a> in the last 50 years. But of course, there\u2019s still more to be done, as the LA area remains one of the smoggiest in the country due to factors including geography, high car dependency, heavy shipping traffic, and a <a href=\"https:\/\/en.wikipedia.org\/wiki\/General_Motors_streetcar_conspiracy\">lack of public transitt<\/a>.<\/p>\n<p>Despite the protestations of industry at the time and since, these rules have not made it impossible for them to operate, or sell cars, or profit from selling cars, in California or any other states that follow its rules.<\/p>\n<p><span>California\u2019s\u00a0<a href=\"https:\/\/electrek.co\/2022\/08\/25\/ca-finalizes-2035-gas-car-ban-a-huge-deal-but-why-not-sooner\/\" target=\"_blank\" rel=\"noopener\">newest set of rules<\/a>\u00a0is<\/span> set to save Californians, and the residents of other states who follow them, hundreds of billions of dollars on health, fuel, and maintenance costs through 2050 by encouraging electrification \u2013 and of course will save thousands of lives due to pollution reductions. Republicans targeted not just California\u2019s regulation on light duty vehicles (ACC II), but also some other truck emissions rules (the ACT and HD low-NOx Omnibus rules).<\/p>\n<p>So, Congress has declared it wants to end California\u2019s progress in protecting its own residents. Despite the massive improvement in health and air quality, and reduction in health costs as a result, republicans in Congress are <a href=\"https:\/\/electrek.co\/2023\/12\/07\/house-republicans-have-once-again-voted-to-poison-you-and-cost-you-trillions\/\">once<\/a> <a href=\"https:\/\/electrek.co\/2024\/09\/20\/house-republicans-vote-to-kill-thousands-increase-fuel-costs-100b-yr\/\">again<\/a> making it clear that they favor poisoning Americans, so much so that they\u2019ll even try illegal actions to do it.<\/p>\n<p>The problem with using the Congressional Review Act in this situation is that it is doubly illegal to do. The CRA gives Congress the authority to roll back government agency actions, like those of the EPA, but it has been rarely used since its passing, since doing so results in a dysfunctional government and an unpredictable business environment.<\/p>\n<p>But the CRA has a time limit, and Congress must act to reverse these rules within 60 days. <span>The EPA approved California\u2019s waiver on\u00a0<a href=\"https:\/\/electrek.co\/2024\/12\/18\/californias-ev-rules-are-a-okay-epa-sources-say\/\" target=\"_blank\" rel=\"noopener\">December 18, 2024<\/a>, which is more than 60 days ago; the<\/span>refore, <a href=\"https:\/\/natlawreview.com\/article\/clock-ticking-republicans-use-congressional-review-act\">we are past the deadline where the CRA can be used<\/a>.<\/p>\n<p>Further, even if it <em>were<\/em> within 60 days, the CRA can\u2019t be used to reject California\u2019s waiver, because it isn\u2019t a \u201crule.\u201d The CRA only allows Congress to change \u201crules,\u201d and the waiver isn\u2019t a rule itself; it\u2019s just EPA telling <em>California<\/em> that <em>it<\/em> can set its own rules. Both the <a href=\"https:\/\/legal-planet.org\/2025\/04\/04\/senate-parlimentarian-confirms-that-california-waivers-are-not-subject-to-the-congressional-review-act\/\">Senate Parliamentarian<\/a> and the <a href=\"https:\/\/www.gao.gov\/products\/b-337179\">Government Accountability Office <\/a>(the <em>real<\/em> government office that holds government to account, unlike Elon Musk\u2019s fake and redundant \u201cDepartment of Government Efficiency\u201d advisory board), along with <a href=\"https:\/\/news.bloomberglaw.com\/us-law-week\/congress-cant-legally-end-californias-tough-air-pollution-law?taid=682dfd400970320001dbcfa7&amp;utm_campaign=trueanthem&amp;utm_medium=social&amp;utm_source=twitter\">many<\/a>, <a href=\"https:\/\/www.congress.gov\/crs-product\/R48168\">many<\/a> <a href=\"https:\/\/www.epa.gov\/state-and-local-transportation\/vehicle-emissions-california-waivers-and-authorizations\">others<\/a> have <a href=\"https:\/\/sensiblesafeguards.org\/factsheets\/backdoor-nuclear-option-why-it-matters-for-us-all-if-the-senate-overrules-the-parliamentarian-overturns-the-filibuster-and-violates-the-cra\/\">recognized<\/a> that this is the case, and <a href=\"https:\/\/www.lee.senate.gov\/services\/files\/D7060B80-6E13-4481-8EC6-63155F546C1A\">Congress knows it<\/a>. But hey, at least they have the oil companies on their side.<\/p>\n<p>So, Congress\u2019 action here is illegal, and doubly so, because the waiver is not a rule, and it is outside of the 60 day window. This action is also dangerous to your health, exacerbates climate change, and will raise Americans\u2019 fuel costs and cede ground to China in the changing global auto industry.<\/p>\n<p>Notably, one republican involved, Mike Lee of Utah, correctly acknowledged that <a href=\"https:\/\/www.lee.senate.gov\/services\/files\/D7060B80-6E13-4481-8EC6-63155F546C1A\">this is an illegal action<\/a>, stating clearly that \u201cCalifornia\u2019s CAA federal preemption waivers cannot be reviewed under the Congressional Review Act (CRA) because the waiver granted by EPA is not a\u00a0<em>rule<\/em>\u00a0as that term is defined in the CRA.\u201d However, regardless of publicly acknowledging that this cannot be done, republicans still did it anyway.<\/p>\n<p>They know that this vote has no legal backing \u2013 but it still took the vote anyway, impotently screaming from the rafters \u201cWE WANT TO KILL YOU!!!\u201d\u2026 which apparently some people still need to hear.<\/p>\n<p>But if republicans know this is illegal, why are they doing it? There are likely a number of reasons: <\/p>\n<ul class=\"wp-block-list\">\n<li>To avoid the filibuster, which would give Democrats a chance to stand up for clean air, and which is not allowed for CRA actions (at least, within the 60 day window\u2026 which we are outside of, so that\u2019s another way republicans are acting illegally).<\/li>\n<li>To avoid having to amend or repeal the Clean Air Act, which would likely raise more eyebrows from the few republican voters with any remaining rationality or self-interest. This action is harder to understand and therefore more likely to go under the radar.<\/li>\n<li>To show to their oil donors that they are aligned in their mission to harm life on earth.<\/li>\n<li>Likely as another meaningless entry into the republican culture war, where the party starts ridiculous fights over nothing in order to stop or distract from positive motion on changes that might help alleviate some of the plight republicans are constantly trying to force on Americans.<\/li>\n<\/ul>\n<p>The vote was 51-44, with 50 republicans and one Democrat voting to harm Americans with this illegal act. The Democrat was Elissa Slotkin of Michigan, who voted for the measure despite the harm it will bring to the auto industry that is so important in her state, which will be made less relevant globally as it retreats in the face of rising competition from China.<\/p>\n<p>The bill now goes to the desk of a convicted felon who is <a href=\"https:\/\/constitution.congress.gov\/browse\/amendment-14\/section-3\/\">Constitutionally barred from holding office in the US<\/a>, where he will undoubtedly mark it with his chicken-scratch, as he promised the oil industry he would do in exchange for <a href=\"https:\/\/electrek.co\/2024\/05\/09\/trump-reportedly-told-oil-execs-hell-end-electric-car-incentives-for-1-billion-in-donations\/\">a billion dollars in bribes<\/a> (which he only received a fraction of).<\/p>\n<p>California\u2019s response may or may not involve legal action \u2013 despite that this is illegal, the CRA also claims that it is not subject to judicial review, which is a violation of the checks and balances enshrined in the Constitution.<\/p>\n<p>California could alternately seek to achieve the same goals through other measures that have no Congressional oversight, such as charging higher registration fees for gasoline-powered vehicles (something which many states, <a href=\"https:\/\/electrek.co\/2020\/07\/10\/california-starts-charging-ev-registration-fees-up-to-175-in-july\/\">including California<\/a>, already <a href=\"https:\/\/electrek.co\/2017\/01\/17\/yearly-ev-fees-to-replace-lost-gas-tax-revenue-are-less-reasonable-than-they-seem-indiana-the-latest-to-scapegoat-evs\/\">stupidly<\/a> do against <em>electric<\/em> cars, at the behest of, once again, <a href=\"https:\/\/electrek.co\/2017\/02\/27\/fossil-fuel-industry-electric-vehicle-fees\/\">the oil industry<\/a> \u2013 and yes, republicans <a href=\"https:\/\/electrek.co\/2025\/04\/30\/republicans-propose-triple-taxing-evs-but-allow-gas-cars-free-ride-on-us-roads\/\">want to do this federally, too<\/a>).<\/p>\n<p>For its part, the California Air Resources Board, the organization responsible for California\u2019s regulations, said \u201cCARB will continue its mission to protect the public health of Californians impacted by harmful air pollution\u201d after the House\u2019s initial CRA vote. So, we hope that CARB will continue to act within the law, and ignore Congress\u2019 violent action opposing clean air.<\/p>\n<p>And California Governor Gavin Newsom reacted, stating \u201cThis Senate vote is illegal. Republicans went around their own parliamentarian to defy decades of precedent. We won\u2019t stand by as Trump Republicans make America smoggy again \u2014 undoing work that goes back to the days of Richard Nixon and Ronald Reagan \u2014 all while ceding our economic future to China.\u201c<\/p>\n<p>Meanwhile, <a href=\"https:\/\/www.heart.org\/-\/media\/Files\/About-Us\/Policy-Research\/Fact-Sheets\/Clean-Air\/Air-Pollution-and-CVD.pdf\">doctors<\/a>,\u00a0<a href=\"https:\/\/envirn.org\/nurses-support-strong-standards\/\">nurses<\/a>,\u00a0<a href=\"https:\/\/www.spglobal.com\/commodityinsights\/en\/market-insights\/podcasts\/crude\/030424-weakening-tailpipe-emissions-rule-us-epa-greenhouse-gas\">scientists<\/a>,<a href=\"https:\/\/www.sierraclub.org\/press-releases\/2024\/01\/sierra-club-statement-ramped-industry-lobbying-epa-clean-vehicle-regulations\">\u00a0environmental groups<\/a>,\u00a0<a href=\"https:\/\/www.ceres.org\/sites\/default\/files\/Letter%20to%20the%20EPA%20-%20Proposed%20Multi-Pollutant%20%26%20GHG%20Emissions%20Standards.pdf\">many businesses<\/a>,\u00a0<a href=\"https:\/\/www.dataforprogress.org\/blog\/2023\/8\/2\/voters-support-the-epas-proposed-vehicle-rules-on-greenhouse-gas-emissions\">people who recognize that they have lungs which they would like to continue using<\/a>, and so on, generally support the strongest regulation possible.<\/p>\n<p><a href=\"https:\/\/www.nrdc.org\/sites\/default\/files\/2025-04\/community-letter-waiver-cra-letter.pdf\">More than 100 clean air groups <\/a>sent a letter supporting the waiver in the face of republican attacks on your health\u2026 and <a href=\"https:\/\/www.lung.org\/getmedia\/3429779a-369b-425e-bf68-df97bee4dbfc\/Health-Groups-Oppose-Undoing-CA-Waivers.pdf\">another one<\/a> led by the American Lung Association, and <a href=\"https:\/\/www.nrdc.org\/press-releases\/127-groups-tell-congress-defend-vehicle-standards\">another one<\/a> led by the Natural Resources Defense Council, and <a href=\"https:\/\/sensiblesafeguards.org\/outreach\/css-and-80-groups-oppose-misuse-of-the-congressional-review-act-to-target-ineligible-policies\/\">another one<\/a> led by the Coalition for Sensible Safeguards. But who listens to\u00a0<em>those<\/em>\u00a0idiots when there\u2019s oil donor money at stake?<\/p>\n<p>That hasn\u2019t stopped other bad actors from stepping in to show support. <span>The auto lobbyist that represents\u00a0<a href=\"https:\/\/www.autosinnovate.org\/about\/our-members\" target=\"_blank\" rel=\"noopener\">virtually every car company<\/a>, which calls itself the \u201cAlliance for Automotive Innovation\u201d despite routinely opposing ele<\/span>ctrification efforts,\u00a0<a href=\"https:\/\/www.reuters.com\/sustainability\/major-automakers-want-congress-bar-california-2035-electric-vehicle-plan-2025-04-28\/\">came out in favor<\/a> of ending California\u2019s clean air rules. This is despite the weasel who runs the organization, John Bozzella, appearing on stage to give a speech when the EPA <a href=\"https:\/\/electrek.co\/2024\/03\/20\/epa-softens-rule-that-would-save-you-billions-and-big-auto-is-still-mad-about-it\/#h-doe-petroleum-equivalency-rule-also-released-despite-auto-lobby-complaints\">implemented rules with similar goals<\/a> on a national level.<\/p>\n<p>Bozzella has long stated that he thinks California and the EPA should have the same set of rules \u2013 but his organization is the one that <a href=\"https:\/\/electrek.co\/2016\/12\/09\/automakers-but-tesla-lobbying-block-epa\/\">originally lobbied Mr. Trump<\/a>, during his first period squatting in the White House, to shatter the <a href=\"https:\/\/obamawhitehouse.archives.gov\/the-press-office\/2012\/08\/28\/obama-administration-finalizes-historic-545-mpg-fuel-efficiency-standard\">single national standard that had been set up under President Obama<\/a>, opening this <a href=\"https:\/\/electrek.co\/2019\/06\/06\/automakers-again-petition-us-ca-govts-to-close-emissions-pandoras-box-that-they-opened\/\">Pandora\u2019s Box<\/a> to begin with. And in case you need a reminder, <a href=\"https:\/\/electrek.co\/2021\/02\/02\/california-wins-the-emissions-fight-automakers-drop-lawsuit-but-still-want-dirty-air\/\">California ended up winning that fight<\/a>, which <a href=\"https:\/\/electrek.co\/2019\/09\/17\/why-epa-cant-revoke-california-emissions-rules-op-ed\/\"><em>somebody<\/em> predicted well ahead of time<\/a>.<\/p>\n<p>And don\u2019t forget: the Alliance Against Automotive Innovation\u2019s opposition to EVs will <a href=\"https:\/\/electrek.co\/2024\/03\/23\/big-auto-is-begging-governments-to-let-them-go-bankrupt-as-chinese-evs-loom\/\">signal the final nail in the coffin for the US auto industry<\/a>. China is getting great at building EVs, to the point that other nations are desperately trying to put up barriers to stop them. But it hasn\u2019t worked, and it won\u2019t work. The only thing that will work is <a href=\"https:\/\/electrek.co\/2024\/05\/12\/tariffs-on-china-arent-the-way-to-win-the-ev-arms-race-taking-evs-seriously-is\/\">getting more serious about EVs<\/a>, and trying to stop them <em>ain\u2019t it.<\/em><\/p>\n<p>And, of course, the oil industry, responsible for untold death and destruction, has also arranged itself on the side of this illegal action to poison Americans and raise their fuel costs, alongside republicans in Congress. <a href=\"https:\/\/electrek.co\/2024\/05\/09\/trump-reportedly-told-oil-execs-hell-end-electric-car-incentives-for-1-billion-in-donations\/\">What a surprise<\/a>.<\/p>\n<p>We, at least, know what side we\u2019re on.<\/p>\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n<p><em>To reduce your carbon footprint and live more sustainably, consider going solar.
